2. General provisions
2.1 By ordering Products through the Site, the User agrees to the terms of sale of Products set out below (hereinafter referred to as the Terms of Sale of Products).

8. Rights and obligations of the parties

8.2 The Buyer undertakes:

9.1 According to the law on consumer protection, food products of good quality must be returned within the first 14 days. You can return the Product to the Seller if it does not suit the shape, style, size, color or configuration. In this case, the entire batch of Goods with the name appearing on the receipt will be returned. The Buyer has the right to exchange such Product for another Product of the seller of the same value, with an additional payment or partial refund.
9.2 If the Buyer refuses the Goods of proper quality, the Seller returns the full cost of the Goods excluding delivery costs. All necessary transportation costs associated with organizing the exchange or return of the Goods are borne by the Buyer.
9.3 It is permissible to return a product of appropriate quality only if the following requirements are met: the appearance is preserved, a document (check, payment) confirming the terms of payment for this product. The Buyer’s absence of a payment document does not deprive him of the opportunity to provide additional evidence of the purchase of the Goods from the Seller.
9.4 If defects are detected in the Product, if they were not specified by the Seller, the Buyer, at his own discretion, has the right:
- demand replacement with a Product of the same brand (same models or purpose);
- demand a replacement for the same Product of a different brand (model, characteristics) with a corresponding recalculation of the purchase price;
- demand a proportionate reduction in the purchase price;
- demand immediate free elimination of defects in the goods or reimbursement of costs for their correction by the consumer or a third party;
- refuse to fulfill the supply contract and demand a refund of the amount paid for the goods (Clause 1, Article 18 of the Law “On Protection of Consumer Rights”).
The Buyer’s absence of a cash or sales receipt or other document certifying the fact and conditions of purchase of the goods is not grounds for refusal to satisfy his requirements.
9.5 If the goods are transferred to the Buyer in violation of the terms of the contract regarding the quantity, assortment, quality, completeness, packaging and (or) packaging of the goods, the buyer may notify the Seller of these violations no later than 20 days after receiving the goods.
If defects are discovered in a product for which warranty periods or expiration dates have not been established, the buyer has the right to make claims regarding defects in the product within a reasonable time, but within 2 years from the date of its transfer to the buyer, unless longer periods are established by law or contract.
The buyer also has the right to make claims against the seller regarding defects in the goods if they are discovered during the warranty period or expiration date (Article 27 of the “Rules for the sale of goods by remote means”).
9.6 In the event of a return/exchange of Goods of inadequate quality, or detection of shortages or other deficiencies for which the Seller is responsible, the Seller assumes all transportation costs necessary to correct the situation.
9.7 All received requests for exchange or return of goods are considered within 48 hours.
9.8 If the Goods are returned to the Seller, the money paid for the goods will be returned in the same way as payment was made.
10. Force majeure
10.1 The Parties are released from liability for non-fulfillment or improper fulfillment of obligations under the Agreement for the duration of force majeure circumstances.
Force majeure means extraordinary and insurmountable circumstances under given conditions that prevent the parties from fulfilling their obligations under this Agreement.
These include natural phenomena (earthquakes, floods, etc.), circumstances of public life (military actions, states of emergency, major strikes, epidemics, etc.), prohibitive measures of government bodies (transport bans, currency restrictions, international sanctions trade ban, etc.).
During this time, the parties have no mutual claims, and each party assumes its own risk of the consequences of force majeure.
11. Confidentiality and information protection
11.1 Personal data of the User/Buyer is processed in accordance with the Federal Law “On Personal Data” No. 152-FZ.
11.2 When placing an order, the User indicates his first name, last name, patronymic, e-mail, contact phone number and address; when filling out the feedback form - name, e-mail and contact phone number; to subscribe to the newsletter – e-mail.
11.3 By providing his personal data to the Seller, the Site Visitor/User/Buyer agrees to their processing by the Seller, including for the purpose of fulfilling the Seller’s obligations to the Site Visitor/User/Buyer under this Public Offer, promoting goods and services by the Seller, conducting electronic surveys, monitoring the results of marketing campaigns, customer support, organizing the delivery of goods to Buyers, holding prize draws among Site Visitors/Users/Buyers, monitoring the satisfaction of the Site Visitor/User/Buyer, as well as the quality of services provided by the Seller, mailings.

12. Duration of the contract
12.1 The fulfillment by the Buyer and the Seller of obligations under this Agreement begins from the moment the Buyer contacts Kidsstars and ends when the Seller and the Buyer fully fulfill their obligations.
12.2 All disputes and disagreements arising during the performance by the Seller and the Buyer of their obligations under this Agreement are resolved through negotiations. If it is impossible to eliminate them, the Seller and the Buyer have the right to seek judicial protection of their interests.
